When asking for help from LEGAL TECHNOPAGAN ZOOM this morning, I was provided this sample Motion to Dismiss prepared by lawyers from the Organization for Supernatural Transformative Works, Spuffy Division.     Suck on that, W&H!     Supreme Oracles Court of the POWERS THAT BE   WOLFRAM & HART, Plaintiff, v. SUNNYDALE AFTER DARK, Defendant   MOTION TO DISMISS   Defendant SUNNYDALE AFTER DARK who moves to dismiss the Plaintiff’s First Claims for Cease and Desist Relief in the Complaint.   The Defendants certify that, pursuant to TPB UR12.TALK, Plaintiff’s counsel opposes the relief requested herein.   FACTS The Complaint alleges defamation of character: (i) the Plaintiff claims that Defendant SUNNYDALE AFTER DARK defamed the Plaintiff in numerous documents detailing the actions and character of said Plantiff CEO of Wolfram & Hart, ANGEL aka ANGELUS aka WORST VAMPIRE EVER in connection with Amicus Brief petitioners BUFFY SUMMERS, SPIKE aka WILLIAM PRATT, HEAD COUNCIL RUPERT GILES, WILLOW ROSENBERG, XANDER HARRIS, DAWN SUMMERS and KATE LOCKLEY.    A. Burden of proof: The Plaintiff has the burden of production to come forward with facts demonstrating a prima facie case.  B. Elements: The Plaintiff alleges that: (i) he is a victim of character assassination; (ii) he suffered an adverse drop in popularity in the Buffyverse; (iv) that adverse action occurred in circumstances giving rise to an inference that Spuffy is more popular than Bangel. The Defendants will not concede that the Plaintiff has plead sufficient facts to establish the first and third elements. C. Burden of proof: The Plaintiff has the burden of proof by clear and convincing evidence.  D. Elements: To state a claim for defamation under Oracle law, a plaintiff must allege: (i) a defamatory statement is not true; (ii) the existence of actual damages or actionability; and (iv) actual malice.   As evidence against the claims of Plantiff, the Defendant SUNNYDALE AFTER DARK submits Pages 1204-1503, 30948-33786, and 603,405-710,379 of the WATCHER’S COUNCIL HANDBOOK, demonstrating that alleged defamatory statements of The Plaintiff are factual in nature and Angel aka ANGELUS aka WORST VAMPIRE EVER has been shown in court to have committed the various crimes and idiocies of which he has been accused.     Additional documents proving the popularity of the pairing of BUFFY SUMMERS and SPIKE (otherwise known as “SPUFFY”) in the public consciousness have been submitted.    Thus, the cease and desist order of WOLFRAM & HART statement to SUNNYDALE AFTER DARK is insufficient to state a claim for defamation. (i): The Plaintiff has not alleged facts showing that the statement was made with actual malice.   CONCLUSION For the foregoing reasons the Defendants’ Motion to Dismiss should be granted and the Claims for Relief should be dismissed.
